Welcome to Averlynxstore. These Terms of Service ("Terms") govern your use of our website, mobile applications, and services. By accessing or using our platform, you agree to be bound by these Terms. As a company based in the Netherlands, we operate in compliance with Dutch and European Union consumer protection laws.

3. Account Registration
To make a purchase or access certain features, you may need to create an account. 4. Products and Ordering
4.1 Product Information
We strive to display accurate product information, including descriptions, pricing, colors, sizes, and availability. All prices are in Euros (EUR) and include Dutch VAT (21%). However, we do not warrant that product descriptions, images, or other content are accurate, complete, reliable, current, or error-free.
4.2 Pricing
All prices are in Euros (€) and include VAT. Prices are subject to change without notice. For customers outside the EU, prices may be displayed with or without VAT depending on your location. We reserve the right to refuse or cancel any orders placed for products listed at an incorrect price.
4.3 Order Acceptance
Your receipt of an order confirmation does not signify our acceptance of your order. We reserve the right to accept or decline your order for any reason, including but not limited to: product availability, suspected fraud, incorrect pricing, or violation of these Terms.
4.4 Pre-Order and Made-to-Order Items
Some items may be available for pre-order or made-to-order. These items will have estimated ship dates noted on the product page. Pre-order deposits are non-refundable unless the order is cancelled by Averlynxstore.
6. Shipping and Delivery
All orders are shipped from our warehouse in the Netherlands using PostNL as our primary carrier. Shipping times and costs are as outlined on our Delivery page. Risk of loss and title for items purchased pass to you upon delivery to the carrier.
7. EU Consumer Rights
As a consumer in the European Union, you have certain statutory rights under EU consumer protection laws:
- Right of Withdrawal: You have 14 days to withdraw from your purchase without giving any reason. See our Returns page for details.
- Right to Conformity: Goods must be in conformity with the contract. If goods are defective or not as described, you have rights to repair, replacement, or refund.
- No unfair terms: Consumer contracts cannot contain unfair terms under EU Directive 93/13/EEC.
8. Intellectual Property
All content on our website, including but not limited to text, graphics, logos, images, audio clips, digital downloads, data compilations, and software, is the property of Averlynxstore or its content suppliers and is protected by Dutch, EU, and international copyright, trademark, and other intellectual property laws.
9. User Conduct
You agree not to use our services to:
- Violate any applicable laws, regulations, or third-party rights
- Submit false, misleading, or fraudulent information
- Interfere with the proper functioning of our website or services
- Attempt to gain unauthorized access to our systems or accounts
- Use automated systems or bots to access our services without permission

- Transmit viruses, malware, or other harmful code
10. User-Generated Content
If you submit reviews, photos, comments, or other content ("User Content"), you grant Averlynxstore a non-exclusive, royalty-free, perpetual, irrevocable, and fully sublicensable right to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display such User Content worldwide.
You represent that you own or have the necessary rights to submit your User Content and that it does not infringe on the rights of any third party.
11. Disclaimer of Warranties
OUR SERVICES AND PRODUCTS ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. THIS does not affect your statutory rights as a consumer under EU law.
12. Limitation of Liability
Nothing in these Terms shall limit or exclude our liability for death or personal injury caused by our negligence, for fraud, or for any other liability that cannot be limited or excluded by law.
Subject to the above, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or use, arising out of or related to your use of our services.
13. Indemnification
You agree to indemnify, defend, and hold harmless Averlynxstore, its officers, directors, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, and expenses arising out of or related to your violation of these Terms or your use of our services.
16. Severability
If any provision of these Terms is found to be invalid or unenforceable, such provision shall be severed from these Terms, and the remaining provisions shall continue in full force and effect.
17. Entire Agreement
These Terms, together with our Privacy Policy, Return Policy, and any other legal notices published by us on our website, constitute the entire agreement between you and Averlynxstore regarding your use of our services.
